Cancellation Policy

1. The Homeowner has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Guests violate any of the terms of this agreement, the rental period shall be terminated immediately. The Guests waive all rights to due process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement.
2. There is an international (outside US) block on the telephone - a calling card is needed for long distance toll calls. Emergency medical and police service can be called by dialing 911.
3. The Guest(s) shall maintain the premises in a good and clean condition, and use the premises only in a careful and lawful manner. Guest(s) shall pay for maintenance and repairs should the premises be left in a lesser condition. The Guest(s) agree that the Guest(s) cause damage to the premises or its furnishings.
4. The Guest(s) shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the bins along the curb during their stay for pickup. Guests are cautioned not to leave trash outside for long periods of time because it attracts animals.
5.The Guest(s) shall pay for any damage done to the premises over and above normal wear and tear.
6. No animals or pets of any kind will be brought onto the premises.
7. The Guest(s) shall not sublet the property.
8. The Guest(s) shall have no other persons reside or sleep on the premises than those listed in this contract.
No substitutions of Guest(s) may be made without written permission from Homeowner.
9. The Guest(s) shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guest(s) shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Quiet hour starts at 10 PM and pool and outdoor noise should be kept to a minimum.
10. There shall be no smoking inside the premises. Smoking is permitted outside the home.
11. Homeowner shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Homeowner’s family. Toilet paper, soap, dish detergent, laundry soap, shampoos, and other consumables are to be purchased by the Guest(s). No reimbursement will be made for unused consumables left at the premises.
12. The Guest(s) and any and all persons the Guest(s) permit on property shall hereby indemnify and hold harmless the Homeowner against any and all claims of personal injury or property damage or loss arising from use of the premises or any object on premises regardless of the nature of the accident, injury or loss or whether supplied by Homeowner or Guest(s). Guest(s) expressly recognize that any insurance for property damage or loss which the Homeowner may maintain on the property does not cover the personal property of Guest(s), and that Guest(s) should purchase their own insurance for Guest(s) if such coverage is desired.
13. In case of rentals longer than 4 (four) weeks, Guest(s) agree to order a professional interim cleaning for every 2 weeks of occupancy at their expense.
14. Guest(s) agree to pay a surcharge of 3 (three) % if Guest chooses to pay by Credit Card.
15. If Guest(s) pay by international bank transfer, all bank cost of this transactions are to be paid for by Guest(s). Often US banks charge up to $25 for receiving an international bank transfer, even if the sender agrees to pay 'all costs' for the transaction with their sending bank. In this case, Guest(s) will have to reimburse Homeowner for any additional fees up to US $25. Any other processing/transaction fee from any other method Guest chooses to use to pay Homeowner, will be the responsibility of the Guest.
16. Guest(s) receive an electricity allowance of $50/week. The Homeowner will use the LCEC website to calculate usage for the dates Guest was in residence. The Homeowner will forward the LCEC Daily Usage Graph to the Guests with return of the Refundable Security Deposit. The Guest agrees to pay the electricity calculated by the consumed KwH times USD $0.27 minus the $50/week allowance which includes equipment usage.
17. Guest(s) agree that Homeowner can hand over Guest(s) Booking Data to US Officials if US Officials ask Homeowner to do so.
18. Guest(s) agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Homeowner enforcing this agreement.
19. Guest(s) expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guest(s) do not intend to make the property a residence or household.
20. We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages.
21. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
22. There shall be no refunds of any portion of rent because of shortened stays or ruined expectations due to work and family emergencies or other commitments
23. If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the Guest(s) stay. Every effort will be made to schedule the showing at a convenient time and not interrupt the Guest’s vacation. Guest(s) shall allow reasonable viewings of the home between 9 AM and 8 PM present or not.
24. It is the Guest(s) responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool or boat dock. Guest(s) agree to have a responsible adult supervising minors while they swim in the pool. Guest(s) is/are hereby notified that the pool and/or boat dock can be dangerous and Guest(s) accepts fully the risks involved. Guest(s) is/are further notified to be cautious when exiting the rear of the home as the pool is open and in close proximity to the entry ways and can be a hazard. There are no rails to prevent a fall into the pool.
Guest(s) assumes full responsibility for any minor(s) in rental party in any action or matter and agrees that no one under the age of 18 years will operate bicycles or Kayaks located on property at any time.
25. Guest(s) agrees that Fireworks and other hazardous materials shall not be used in or around the property.
26. Guest(s) agrees not to access the “owner’s closet”, even if unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults.
27. Guest(s) is advised that the property contains a gas grill and will seek help from management if the proper operation of such items is not fully understood. The grill will be clean upon Guest’s arrival with propane (2) tanks available. Grill will be cleaned and tanks filled by guest before departure or a cleaning fee and refill fee will be deducted from Damage Deposit.
28. The property has smoke alarms installed and they are believed to function properly at the time of rental. These smoke alarms are linked directly to the fire department. Guest(s) will notify management without delay if a fire alarm “chirps” or has a low battery condition.
29. Guest(s) is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one.
30. Guest(s) shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it’s prudent to do so.
The Security System is not available for Guest use.
31. Valuable items left behind by Guest(s) will be held for the Guest(s) and every reasonable effort will be made to contact the Guest(s) for return. If items are not claimed for longer than 6 months they shall become the property of the Homeowner. The Homeowner shall not be held liable for condition of said items.
32. Cable TV is provided and service level has been chosen by the Homeowner. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.
33. Wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
34. Guest(s) agrees that Air conditioning shall not be set below 70 degrees and heat shall not be set above 76 degrees, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation.
