Cancellation Policy:
25% fee if cancelled 60 days or more prior to stay. 100% fee if cancelled within 60 days. We encourage trip insurance and it is available for just 7% of rental rate.

Terms and Conditions:
SHORT-TERM RENTAL AGREEMENT

This Agreement is made in Cardiff by the Sea, CA on {{CURRENT_LDATE}} between BETTER Vacation Rentals, Inc. (Broker), and {{REQ_NAME}}, (Guest). This Agreement is for rental of the property located at {{PROP_ADDRESS}} (rental property).

Agreement Acceptance: Guest's signature on this agreement, or payment of rent, or taking of possession of the rental property after receipt of this agreement is evidence of Guest's acceptance of this agreement and all of its terms.
Term: The term of occupancy by Guest is a {{REQ_DAYS}} period from {{REQ_ARRIVE}} - {{REQ_DEPART}} (rental term). Term begins at {{REQ_CHECKIN::3 pm}} of the arrival day, and ends at {{REQ_CHECKOUT::10 am}} of the departure day. Early arrival or failure to depart at the agreed upon time will result in an extra day's rent.
Rental Payment: Guest agrees to pay rent in the amount of ${{X_REQ_ADJRENT}} rent, ${{REQ_CLEANINGCOST:cf}} normal cleaning, ${{REQ_TAXCOST}} tax, and ${{REQ_MISCCOST}} {{REQ_MISCCOSTLABEL}}. Total: ${{REQ_TOTALCOST:cf}}. Twenty-five percent (25)% is due upon reservation and the balance is due 60 days prior to arrival. Payments must be made by major credit card or a personal US check if arrival is more than 60 days in the future. Payment in full must be received at agreed upon times or reservation is subject to cancellation according to schedule and terms in #7 below.
Damage Waiver: Guest has purchased a damage waiver from Broker. Said damage waiver covers up to $1,500 in accidental damages reported to Broker. Theft of guests' personal property is not covered, nor is damage due to intentional misuse, negligence, smoking, pets, or exceeding the occupancy limit. Owner and Broker reserve the right to collect damages exceding or not covered by damage waiver from Guest. The damage waiver policy is available for examination prior to acceptance via email or fax.
Cancellations: Cancellations must be made must be verified by response in writing from Broker to be valid. All cancellations, regardless of the circumstances, are subject to a 25% service charge. Cancellations made 61 or more days prior to scheduled arrival will result in full refund less the service charge. There will be no refund on cancellations made within 60 days of scheduled arrival. There are no refunds or credits for unused lodging.
Assignment and Sublease: Guest may not assign this Agreement or sublet the rental property or any portion thereof without prior written consent of the Broker. Only those guests who are explicitly stated on this agreement are allowed to be present at the rental property.
Purpose: Guest agrees to use and occupy the rental property for short-term vacation purposes only. Guest may not use the rental property for any other purpose without prior written consent of Broker. Guest agrees to refrain from using the rental property for any unlawful purpose or any purpose deemed hazardous.
Occupancy Limits: The maximum occupancy is {{REQ_GUESTLIMIT}}. The person signing this agreement must be 25 years of age or older (unless active or honorably discharged military with the express consent of Broker) and must be one of the occupants throughout the term of the rental agreement. Failure to comply with this requirement is grounds for immediate eviction and forfeiture of rents and deposits.
Smoking: There is no smoking allowed in the rental property or its balconies, patios, courtyards, or surrounding area. Evidence of smoking will result in immediate eviction and/or full forfeiture of all rents, deposits and the full cost of remediation and lost rents.
Rules and Regulations: The property being rented is either a condo in a residential development or a house in a residential neighborhood. There may be people living nearby who are year-round residents. Excessive noise, rowdy behavior, loud music or other nuisances will not be tolerated by the development or by us. If subject property is a condominium, tenant agrees to abide by any and all Rules and Regulations including, but not limited to, rules with respect to noise, odors, disposal of refuse, parking, and use of common areas. There will be a copy of said Rules inside the rental upon your arrival and an advance copy is available upon your request via email. Violation of any rules and regulations will be deemed a material breach of this rental agreement, and your deposits shall be forfeited and you must immediately vacate and pay any damages and or fines upon demand. Tenant also agrees to pay any fines assessed by the City of Oceanside which are a result of their violation of City ordinances to noise, vandalism and overcrowding, and to vacate the property immediately upon being cited.
Repairs/Service Calls/Refunds: Guest will immediately upon taking occupancy make an inspection of the property and report to Agent any damage, breakage, malfunction, or other problem on the property. Guest agrees to properly use and operate all furnishings, appliances, plumbing fixtures, electronics, fireplaces, and other equipment available on the rental property. Guest agrees to return the rental property to the condition it was at the commencement of the rental term. Broker cannot guarantee against mechanical failure of any item within the property. Please report any inoperative items to our office immediately. Broker will make every reasonable effort to have repairs done quickly and efficiently. Should a repair person make a call to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be the Guest(s) responsibility. No refunds or rent reductions will be made due to failure of appliances or equipment. Barbeque grills are not available in all rental properties. Cleaning of the barbeque is the sole responsibility of the guest prior to and after each use. Broker is not responsible for the cleanliness or operation of barbeque grills. Broker does not supply charcoal, lighter fluid or matches,or propane. Use of the barbeque is at the sole discretion of the guests. Please be careful if using the barbeque grill. Fire and/or smoke damage will be the responsibility of the guest.
Entry and Inspection: Owner and Broker shall have the right to enter the premises: (a) in case of emergency, (b) to make necessary repairs, (c) to verify that the terms of this agreement are being met, (d) to exhibit the premises to prospective or actual purchasers, mortgagees, tenant, workmen, or contractor; or (e) when tenant has abandoned or surrendered the premises.
Termination: This Agreement may be terminated by Broker in the event of breach by Guest of any portion of this Agreement. In the case of termination, Broker may, to the extent permitted by law, re-enter the rental property.
Compliance with Law: Guest agrees to comply with all statutes, ordinances, and requirements of all municipal, state, and federal authorities.
Pets and Animals: Pets and animals are not allowed on the rental property at any time. Presence of animals is grounds for immediate eviction and forfeiture of all deposits and rents.
Parking: There is one parking space assigned to this condo in the garage. You will be given a pass at check in (& the space number). It is VERY important that you use only this space & display the tag at all times (they tow in NCV and at the beach). Parking is at a premium at the beach in the summer, but there is a city pay lot across the street if you bring more than one car. Boat, RV, etc. parking is not allowed at NCV. The height limit is 6'6” and 21' is the length limit.
Construction and Noise: Guest understands that the property you are renting is either a condo in a residential development or a house in a residential neighborhood, not a hotel or timeshare in a resort. Other residents own properties nearby. These residents and developments have the right to perform construction on their property without notification to the Owner or Broker of the property you are renting. If there is construction from nearby sites, or the owners association is performing construction, neither Owner nor Broker shall be liable for these events, as they are beyond their control. No rebate will be offered in these circumstances.
Holding Over: Because of the nature of the short-term winter and summer vacation rentals, guest agrees that any unauthorized "holding over" of the property past the stated rental period could severely jeopardize Broker/Owner and cause loss of rental income from other previously booked tenants, temporary and/or permanent loss of business, goodwill and reputation; and could force Broker/Owner to breach an agreement with similar short-terms summer or winter vacation tenant(s) who may have reservations during guest’s unauthorized "holder over" period. In this event Owner/Broker may be legally liable for damages to said other tenant(s). Guest should be aware that unauthorized "holding over" has been construed as a factor in establishing "malicious continuing occupation" of rental property that may entitle Owner/Broker to treble damages in any unlawful detainer action. Guest also recognizes that unauthorized "holding over" could be grounds in court as a cause of action for intentionally interfering with Owner/Broker’s prospective business position and guest agrees to fully indemnify Owner/Broker for any and all losses sustained as a result of any such "holding over" including attorney’s fees and expenses.
Physical Possession: If Owner and Broker are unable to deliver possession of the premises at the start thereof, Owner/Broker shall not be liable for any damage caused thereby, nor shall this agreement be void or voidable by guest, but guest shall not be liable for any rent until possession is delivered. Broker will make every reasonable attempt to find comparable accommodations if Owner or Broker is unable to deliver possession. Guest may terminate this agreement is possession is not delivered within one day of the start of the term hereof.
Waiver: No failure of Owner or Broker to enforce any terms or condition hereof shall be deemed a waiver of such terms or condition or any other term or condition of this agreement. The acceptance of rent by Owner or Broker shall be waive the right of Owner or Broker to enforce any term hereof.
Heirs and Assigns: This Agreement shall extend to and be binding on representatives, heirs, executors, successors, and assigns of the respective parties as if they were in all cases named parties to this Agreement.
Indemnification: Guest agrees to half Owner and Broker harmless from any and all claims for damages or injuries occurring in the premises or any part thereof, or in common areas thereof, and to indemnify Owner/Broker for any and all losses sustained as a result of any such claims, including attorney’s fees and expenses, unless such damage is the result if actual negligence or unlawful act of Owner of Broker. Broker shall not be liable for negligence or unlawful act of Owner.
Arbitration/Avenue/Law: Parties agree that any controversy or dispute arising from or in connection with this Agreement, its interpretation, performance or termination, shall, upon demand of a party hereto, be submitted to and decided by binding arbitration at JAMS-Endispute, Inc. or another mutually agreeable arbitrator or arbitration facility in Orange County, California. If the parties are unable to mutually agree to an arbitrator within 10 days of a request for arbitration then an arbitrator shall be appointed by JAMS-Endispute, Inc. The arbitration shall be conducted pursuant to the California Code of Civil Procedure with discovery being determined by the arbitrator. There shall not be any court action except as provided by California law for judicial review of arbitration proceedings. Judgment upon the award made by the arbitrator(s) may be entered in any court having jurisdiction thereof. The following matters are excluded from arbitration hereunder: (a) a judicial or non-judicial foreclosure or other action or proceeding to enforce a deed of trust, mortgage, or unreal property sales contract as defined in Civil Code 2985, (b) an unlawful detainer action, (c) the filing or enforcement of a mechanic’s lien, (d) any matter which is within the jurisdiction of a probate court, or (e) an action for order of attachment, receivership, injunction, or other provisional remedies. None of the foregoing shall constitute a waiver of the right to arbitrate under this provision.
Severability. Whenever possible, each provision of this Agreement will be interpreted in such manner as to be effective and valid under applicable law. If any provision of this Agreement is held to be prohibited by or invalid under applicable law, such provision will be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of this Agreement.
THE UNDERSIGNED HAS READ AND UNDERSTANDS THIS RENTAL AGREEMENT AND AGREES TO ADHERE TO ALL TERMS AS A CONDITION OF USE AND THE USE BY FAMILY, GUESTS, AND INVITEES.

Broker is authorized to charge my credit card for any damages in excess of the $1500 coverage by the damage waiver, or damages or theft not covered or reported by me. Damage as a result of smoking or excess occupancy is not covered by the damage waiver. Violations and fines are not covered by the damage waiver and will be paid by Guest and may be charged by Broker to credit card on file or collected by whatever legal means necessary.
