Cancellation
It is understood that unforeseen circumstances may occur which can cause guests to alter or cancel their travel plans. It is recommended that guests take out adequate cancellation or vacation insurance through their insurance broker or travel agent which would provide adequate coverage for vacation cancellations.
Guests reserve the right to amend or cancel their reservation subject to the cancellation policy described herewith.
Guest cancellation must be in written form (email or online form submission) to the owner.
The owner reserves the right to cancel a guest reservation if payment has not been received in full in accordance with the conditions set out in the reservations and payment section above.
The following cancellation charges apply to all rentals:
More than 60 days before arrival date – loss of deposit
Less than 60 days before arrival date – there will be no refund for cancellations within 60 days of arrival and the full rental amount will be forfeited.
Checking out of the rental home earlier than your pre-booked departure date will be considered a cancellation of the remainder of your vacation. No refunds will be given for early check out.
In the unlikely event that the owner has to cancel a guest reservation due to any unforeseen circumstances, a 100% of the funds paid by the guest to the owner for the purpose of the rental will be refunded. The guest agrees that the owner will not be held accountable by the guest for any consequential expenses or losses the guest may have incurred as a result of an unforeseen cancellation.
Terms and Conditions
The Owner, offers the short term vacation rental of the ‘Emeralds Cove’ property named on the Booking Confirmation, to the person of 21 years or over named as the Party Leader and to the party members named (on the Booking Confirmation), hereinafter referred to as the Guest, under the terms set out below.
Reservation and Payment
Reservation Request
Following a reservation request, guests will be provided with a quotation via email. The quotation is valid for a period of 24 hours. During this period the property is not confirmed for the guest & interested third parties have the right to make a reservation. The reservation is only confirmed after the required payment is received.
Please note that during peak seasons several guests may inquire at the same time for rental of the property. The owner reserves the right to accept any booking for the property from a third party which submits the required payment.
Confirmed Reservation
Following the reservation request, a Quotation is issued. The guest must review the Quotation and the Terms and Conditions of the rental. Where the guest agrees to the above, payment is required to confirm the reservation. Upon receipt of the required payment the guest will be issued a Booking Confirmation. Only upon the release of a Booking Confirmation is the property held for the guest.
Required Payment
The Guest will be invoiced for the required payment.
The Guest agrees that deposit of the required payment signifies their full acceptance of the Terms and Conditions. The Guest further acknowledges that the Guest has read and accepted these Terms of Conditions provided along with the quotation and listed on the Emeralds’ Cove website at: www.emeraldscove.com
20% of the rental amount is required (or the full rental amount if the reservation is being made within 60 days of arrival) before the reservation request can be confirmed.
Payments can be made by PayPal, credit card, or bank transfer. Any bank fees such as returned check fees, transfer fees or foreign currency exchange fees will be paid by the guest.
Final and full payment is due 60 days prior to arrival. In the event of late payment, or failure to pay, the owner reserves the rights to levy the cancellation penalty percentage charges against any money that the Guest has paid in advance and cancel the booking of the Guest. Where the money paid in advance is insufficient to cover the calculated percentage, the owner reserves the right to exercise any legal remedies to pursue the amount owed by the Guest.
Check In
Check in at the property is after 4:00 pm on the date of arrival as specified on the Booking Confirmation.
Please note that early arrival is not permitted unless previously agreed to with the owner. Property management scheduled maintenance, inventory inspections & housekeeping require this time to make ensure all inspections are carried out to prepare the property for occupancy.
Checkout
Checkout is not later than 10:00 am on the day of departure as specified on the Booking Confirmation.
Any request for a late departure must be made in advance so to arrange with the Property Management Company, housekeeping and to ensure no scheduled activities or guests are expected that would be affected by the late check-out. Any late departure will incur a minimum late departure fee of $80.00 up to a full day’s rental. The amount will be relayed to the guest at the time it is approved.
If a guest does not depart the property at the checkout time on the day of departure specified in the Booking Confirmation without previous approval, the guest will be liable for a penalty charge of one day’s rental. Please understand that preparing the property for arriving guests includes cleaning and inspections which take many hours for a large home.
Guest(s) shall leave premises in clean, undamaged condition. If unit is not left in suitable condition, guest understands that agent reserves the right to charge guest for any repairs or special cleaning.
Accommodation
The property has a maximum occupancy capacity for 16 persons. Each bedroom may only be occupied up to the bed configuration provided in that room. The guest agrees to comply with the occupancy limits for which the home is authorized and only guests who have been declared on the guest registration form. Guests who do not comply with the occupancy limits are in violation of Florida state law. The owner reserves the right to evict the guest from the property with no compensation or refund in the event of over occupancy or if it is found that guests staying at the home have not been declared on the guest registration form at the time of booking.
The property is provided only for the persons indicated by the guest on the booking form at the time of booking. Any changes or additional guests staying at the property must be relayed to the owner.
The guest agrees that at no time will they allow minors to be left unattended or unsupervised in the property at any time.
The guest agrees that it may be necessary for staff or agents of our property management company to enter the premises during our guests stay in order to perform routine maintenance or repairs. Scheduled pool cleaning occurs twice a week and the pool cleaners are authorized access the lanai/pool area in order to carry out the scheduled pool cleaning and or pool maintenance.
Pool and spa electric heat is provided at the property free of charge. The equipment employed to heat the pool and/or spa water is an electric powered heat pump. This equipment is designed to work normally when the outside air temperature is above 55F. During the winter months and on rare occasions when the temperatures fall below 55F, the equipment will no longer function as desired and the pool heating will cease. There will be no compensation for times when the electric pool heat ceases due to cold outside air temperatures. Additionally there will be no compensation for pool heat equipment failure. This stated, the owner has a local Property Management Service which maintains the pool equipment routinely with qualified pool technicians and it is rare that the electric pool heater would become inoperative. The spa is not a hot tub. The water in the spa and the water in the pool are within the same flow circuit and use the same heating system and temperatures for each unit are not able to be set separately.
The guest agrees that all pool rules posted and in the house manual must be complied with at all times. Additionally the guest agrees that minors or guests who are not capable of swimming unsupervised will not be left unattended by the pool area. For guest safety a safety fence separating the pool from the home is maintained in place, it should only be removed by the guest when the area is supervised by an adult guest who can swim and supervise responsibly. When the area is not being used the guest should put the safety fence back in place to prevent unwanted pool entry.
The guest agrees that all pool safety equipment must be checked upon arrival and any faulty or missing equipment must be reported to the property management company immediately & before pool use.
The property is a short term rental provided on a self-catering basis. Complimentary starter items of toilet paper hand soap and trash bags are provided. It is the guest responsibility to purchase additional supplies for the duration their stay.
Smoking
For the comfort and safety of guests, the property is designated a no smoking zone.
Animals and pets
Animals and pets are not permitted in the property.
In the event a guest brings a pet to the property then the owner can elect to evict the guest from the home with a loss of any rental payment submitted by the guest. Additionally a cleaning and sanitation charge of $500.00 will be charged to the guest.
Protecting the property and its contents
The guest agrees to take the utmost care of the property and its contents to prevent damage, breakage or loss of any of the property contents provided.
Guests are renting a private property, in the unlikely event that any damage or loss occurs that cannot be resolved between you, the guest, and the owner, further proceedings may be instigated against you by the property owner.
The management company will inspect the property for loss, damage, cleanliness etc. following your departure. The Guest (lead renter) will be liable for all damage or loss to the property and its contents. Please treat the home with respect and leave it as you found it.
Accidental Damage Insurance
The guest agrees to purchase accidental damage insurance at a cost of $49.00 to cover any accidental damage that occurs during the guests stay up to a maximum of $2000.00. The policy does not cover acts of willful damage, theft, excessive trash removal or additional cleaning charges that are required. Damages not reported prior to checkout are not covered by the accidental damage insurance policy. For coverage the guest must report any damage to the owner & the property management company prior to checkout. An online Accidental Damage Form is available online and must be submitted. If due to no internet availability the form cannot be submitted online a telephone call to the owner & the property management company giving all the details of the damage as required by the insurance company must be made.
Refundable Deposits and Credit Card Pre-authorizations
The guest agrees that either a deposit of $500.00 will be made or a credit card pre-authorization in the amount of $500.00 will be pre-authorized on the Guests credit card. This will be used to cover any damage or loss of property that is incurred at the property during the guests stay which is not covered by the accidental damage insurance policy. If damage or loss above this amount is determined, the guest will be responsible up to the amount required for replacement of the item(s).
If you have any problems
In the unlikely event of anything being wrong with your vacation home, the management company must be informed at the earliest opportunity during your vacation and given a reasonable amount of time (24 hours is normal) to address any issues. You will be liable for any damage or loss caused by your own actions if you do not wait for the management company to perform their duties.
Every effort will be made to fix all issues in a timely manner. However, no compensation will be paid for issues beyond our control regarding equipment failure such as air conditioning units, refrigerators, freezers, televisions, games room equipment etc.
No complaints will be accepted after your vacation if the management company were not informed of the circumstances of the problem during your vacation.
Pest control is performed regularly but Florida is regarded as a tropical state and insects may be a problem. Details are posted in the home if an extra visit from the pest control company is required.
In the unlikely event of us being negligent and/or in breach of our contract with you, our liability shall be limited to the cost of your booking with us.
The owner or its representatives may enter the Property at any time, without notice, for the purposes of protection and/or maintenance of the Property. Wherever possible, advance notice to the Guest prior to such entrance will be made.
Liability limitation
The owner and property manager have made all reasonable efforts to provide advice and safety information for the guest in the Vacation Home Guidelines at the Property. It is the responsibility of the Guest to ensure the advice and safety information is reviewed and understood by all guests. The property manager or owner will clarify and provide any further information required to make the guests stay, a safe and pleasant one. Additionally:
It is recommended that the guest has adequate insurance coverage for the duration of the stay at the property to cover medical, injury or personal loss. It is in the guests best interests to take out travel and medical holiday insurance to cover unforeseen circumstances which may necessitate the cancellation of your booking. You should have adequate medical insurance and cover for your personal belongings for the duration of your stay, including travel both to and from the property. The owner and the property manager will not accept liability for personal loss or injury to the guest during the rental period.
The owner and property manager will accept no responsibility for and shall not be liable in respect of any death, injury, loss or damage or alterations, delays or changes arising from circumstances outside our control such as war or threat of war, acts of violence, civil disobedience, fire, floods, hurricanes or any other adverse weather conditions, government action, technical problems with transport, closure or congestion at airports, cancellations or changes of schedules by airlines or theft from the property, both interior and exterior.
The owner and property manager accept no responsibility or liability for loss, theft or damage to personal items while traveling to the property, staying in the property or after departure from the property or for any personal items left behind by the guests.
The Owner has a local property management company and makes all reasonable efforts to maintain the property and its equipment in good working order. When required, repairs will be made and if possible done within 24 hours. No refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to): inoperable appliances, air-conditioning units, pools and/or spas. No refunds will be given for unfavorable weather, early departure, utility or internet service interruption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TVs, audio, telecoms, cable reception or computer equipment.
The Guest shall be solely responsible for any property damage, accident injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guest(s) use of the premises or the items of personal property provided by the Owner. Guest(s) shall inspect and be familiar with proper use and application of such items prior to using them. Guest(s) hereby agrees to INDEMNIFY and hold the homeowner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises or the items of personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect thereto. Guest(s) shall leave premises in clean, undamaged condition. If unit is not left in suitable condition, guest understands that agent reserves the right to charge guest for any repairs or special cleaning.
A great deal of care has been taken to ensure the accuracy of information provided. However, facilities and services may not be open or available due to renovation/maintenance works, adverse weather etc. When we are aware that a facility or service advertised in the information provided will not be available during the period of your stay, we will take steps, wherever possible, to notify you prior to travel.
At times it may be necessary to remove items from the property or replace items at the property with similar items of an equivalent or better standard. Wherever possible, we will endeavor to notify you of such changes prior to travel but can accept no responsibility for facilities that are removed, different or in addition to those previously advertised.
The owner reserve the right to reasonably amend items in the property and any of the terms and conditions set out herewith.
Please note that Emerald Island Resort does not allow coaches, commercial vehicles, trailers or RV's. It is the guest responsibility to arrange offsite parking for these types of vehicles.
